Bridgestone Rivals - Cuộc đua Đỉnh Cao 2024 ("Cuộc thi") được tổ chức bởi Bridgestone Asia Pacific Pte Ltd, có trụ sở đăng ký tại 83 Clemenceau Avenue, Tầng 8, Singapore 239920 ("Bridgestone").

Bằng việc tham gia Cuộc thi, tất cả các Người tham gia đều chấp nhận và đồng ý tuân theo Thể lệ và Thể lệ Thi đấu (được định nghĩa bên dưới đây). Người tham gia cần phải đăng ký để tham gia cuộc thi.

Các giải thưởng bao gồm một ghế mát xa OSIM và các giải thưởng khác (Bridgestone quyết định, sau đây gọi là "Giải thưởng") và sẽ được trao theo Quy chế Chính thức và Thể lệ Thi đấu.

1. ĐIỀU KIỆN THAM DỰ HỢP LỆ

1.1 Thời gian đăng ký; Sự chấp nhận Thể lệ và Thể lệ Thi đấu
Để tham gia Cuộc thi và đủ điều kiện nhận Giải thưởng, Người tham gia cần phải:
a) Comply with entry requirements for the Competition. a) Tuân thủ các yêu cầu tham dự Cuộc thi được đăng tải tại www.bridgestonerivals.com

b) Chấp thuận các điều khoản và điều kiện được nêu rõ trong trò chơi điện tử mô phỏng đua xe có tên “Forza Motorsports”, phiên bản thứ tám (mã hiệu: Steelhead), bao gồm cả các bản cập nhật theo thời gian (“Trò chơi”) - bao gồm nhưng không giới hạn ở việc chấp nhận và thừa nhận rằng "Bằng cách tham gia sự kiện này, bạn (Người tham gia) đồng ý chia sẻ gamertag, địa chỉ email, vị trí với Bridgestone và các công ty liên kết của Bridgestone" và đồng ý được Bridgestone hoặc các công ty liên kết của Bridgestone liên hệ liên quan đến Cuộc thi.

c) Đăng ký với Bridgestone tại www.bridgestonerivals.com và hoàn thành đăng ký cần thiết cùng các biểu mẫu liên quan đến Giải thưởng, được Bridgestone yêu cầu để đủ điều kiện nhận Giải thưởng.

d) Có đăng ký Game Pass hợp lệ và bản Trò chơi hợp lệ hoặc giấy phép hợp lệ để chơi Trò chơi tại thời điểm diễn ra Cuộc thi và trong Thời gian đăng ký theo quy định dưới đây.

e) Đủ 18 tuổi trở lên hoặc đã đạt đến độ tuổi tối thiểu để ký hợp đồng độc lập mà không cần sự đồng ý của cha mẹ theo pháp luật được áp dụng cho địa điểm được đăng ký trong tài khoản đăng ký Game Pass của họ, tùy theo độ tuổi nào cao hơn, tại thời điểm đăng ký.

f) Nộp thời gian đua theo các quy tắc hoặc hướng dẫn mà Bridgestone có thể đăng tải và cập nhật theo thời gian tại www.bridgestonerivals.com; và

g) Để đủ điều kiện nhận Giải thưởng, yêu cầu tối thiểu có hai (2) Người tham gia đã đăng ký tại bất kỳ Quốc gia hợp lệ nào.

h) Thời gian đăng ký:

Thời điểm bắt đầu (Giờ UTC): Thứ 5, ngày 20 tháng 6 năm 2024 từ 00:00

Thời điểm kết thúc (Giờ UTC): Thứ 4, ngày 10 tháng 7 năm 2024 lúc 23:59 giờ

Người tham gia phải đáp ứng tất cả các điều kiện nêu trên và tất cả các biểu mẫu đăng ký phải được hoàn thành và nhận bởi Bridgestone trong Thời gian đăng ký.

Bằng cách gửi biểu mẫu đăng ký và tham gia Cuộc thi, Người tham gia đồng ý rằng họ (i) đủ điều kiện để đăng ký và tham gia; (ii) đã đọc và chấp nhận Quy chế Chính thức, Thể lệ Thi đấu và Chính sách Dữ liệu Cá nhân của Bridgestone và Quy chế Chính thức sẽ tạo thành hợp đồng ràng buộc giữa Người tham gia và Bridgestone. Người tham gia đồng ý chịu ràng buộc bởi Quy chế Chính thức, Thể lệ Thi đấu và các quyết định của Bridgestone trong bối cảnh của Cuộc thi. Người tham gia thừa nhận rằng các hoạt động của Microsoft và bất kỳ đối tác hoặc nhà thầu khác của Bridgestone đều tuân theo các điều khoản và điều kiện riêng cùng chính sách bảo mật của họ. Bridgestone không chịu trách nhiệm cho bất kỳ điều khoản sử dụng hoặc chính sách nào khác ngoài chính sách của mình. Người tham gia đồng ý rằng Bridgestone có toàn quyền và toàn quyền quyết định loại Người tham gia nếu họ vi phạm bất kỳ điều khoản nào của Thể lệ, Thể lệ Thi đấu hoặc nếu hành vi của họ trái với tinh thần hoặc uy tín của Cuộc thi.

Bridgestone có quyền:

a) thay đổi, sửa đổi hoặc bổ sung Quy chế Chính thức và Thể lệ Thi đấu này tuỳ từng thời điểm mà Bridgestone cho là phù hợp;

b) hủy bỏ, thay đổi hoặc tạm dừng Cuộc thi, hoặc bất kỳ phần nào của Cuộc thi nếu gian lận, vi-rút, lỗi hệ thống hoặc bất kỳ sự kiện không lường trước hoặc sự kiện không mong muốn nào xảy ra ảnh hưởng đến việc triển khai, tính an toàn, sự công bằng và/hoặc tính minh bạch của Cuộc thi.

điều chỉnh, tạm dừng, hoãn lại hoặc ngừng hoạt động, tạm thời hoặc vĩnh viễn, bất cứ lúc nào và theo thời gian, Cuộc thi hoặc bất kỳ phần nào của Cuộc thi, có hoặc không có thông báo trước, vì những lý do nằm ngoài tầm kiểm soát hợp lý của mình, bao gồm, nhưng không giới hạn bất kỳ sự kiện Bất khả kháng nào (Sự kiện Bất khả kháng được định nghĩa trong Mục 5(h) bên dưới

1.2 Nơi cư trú
Người tham gia phải là công dân hợp pháp tại một địa điểm hợp lệ để tham gia Cuộc thi. Phụ lục 1 trình bày danh sách tất cả các khu vực hợp lệ và phân loại khu vực tương ứng của họ (“Khu vực hợp lệ”).

1.3 Nhân viên Bridgestone; xung đột lợi ích
Các cán bộ, giám đốc và nhân viên của Bridgestone, Microsoft, Turn 10 Studios, các công ty con và công ty liên kết của họ, cũng như tất cả các đơn vị quảng cáo, tiếp thị và đánh giá, những người tham gia phát triển, sản xuất hoặc phân phối tài liệu cho Cuộc thi này và các thành viên gia đình trực hệ (cha mẹ, cha dượng/mẹ kế, ông bà, con cái, con riêng, anh chị em ruột, bạn đời dân sự hoặc vợ/chồng) hoặc những người sống trong cùng một hộ gia đình (có quan hệ huyết thống hay không) đều không được phép tham gia Cuộc thi.

2. ĐIỀU KIỆN THAM DỰ CUỘC THI

2.1 Quyền xác minh đủ điều kiện tham dự Cuộc thi

Người tham gia phải cung cấp bằng chứng đủ điều kiện. Bridgestone có quyền xác minh điều kiện của Người tham gia (bao gồm nhưng không giới hạn ở bất kỳ yêu cầu về độ tuổi tối thiểu, cư trú hợp pháp hoặc các yêu cầu khác theo luật pháp và quy định của Quốc gia đủ điều kiện) bất cứ lúc nào trong thời gian diễn ra Cuộc thi ở phạm vi cần thiết cho mục đích của Cuộc thi bằng cách yêu cầu Người đua xuất trình bất kỳ giấy tờ chứng minh đủ điều kiện nào mà Bridgestone cho là phù hợp. Sau khi Bridgestone xác minh giấy tờ chứng minh đủ điều kiện (nếu có) do Người đua cung cấp, Bridgestone có quyền loại bỏ và bác bỏ tư cách tham dự Cuộc thi của Người đua hoặc tước quyền nhận Giải thưởng của những người chiến thắng vì bất kỳ lý do gì.

Nếu không tuân thủ các thủ tục xác minh sẽ dẫn đến việc Người tham gia bị loại khỏi Cuộc thi và / hoặc thu hồi Giải thưởng.

2.2 Các bài dự thi không hợp lệ

Bridgestone sẽ không chấp nhận các bài dự thi Cuộc thi:

a) Được tự động tạo bằng máy tính;

b) Được thực hiện bởi bên thứ ba hoặc hàng loạt;

c) Đã bị thay đổi, tái tạo, giả mạo hoặc can thiệp; hoặc

d) Không đầy đủ.

Ngoài ra, Bridgestone sẽ bác bỏ bất kỳ lượt tham dự Cuộc thi nào được thực hiện bằng gamertag không được liên kết với tài khoản Game Pass mà Người đua đã đăng ký với Bridgestone thông qua www.bridgestonerivals.com

2.3 Bài dự thi Cá nhân

Mỗi Người tham gia chỉ được tham gia Cuộc thi với một tài khoản. Các bài dự thi Cuộc thi thay mặt cho người khác sẽ không được chấp nhận và không được phép gửi bài dự thi chung.

2.4 Hình ảnh, Âm thanh và Đoạn phim

Người tham gia đồng ý được phỏng vấn, chụp ảnh và quay phim trong bất kỳ hoặc tất cả các giai đoạn của Cuộc thi, và Bridgestone, các công ty cùng tập đoàn và bên được ủy quyền của họ có quyền sử dụng và khai thác bất kỳ cảnh quay, phân lớp, hình ảnh tĩnh, âm thanh và trích dẫn cho mục đích phát sóng và quảng cáo của riêng họ liên quan đến Cuộc thi, tất cả các trận chung kết và / hoặc Cuộc thi, trên cơ sở vĩnh viễn, trên tất cả các phương tiện truyền thông. Sự xem xét cấp các quyền được nêu trên bao gồm các Giải thưởng được chỉ định tuân thủ với Thể lệ và Thể lệ thi đấu. Việc Người tham gia cấp các quyền được quy định tại đây cho Bridgestone là để đổi lại việc Bridgestone cấp cho Người tham gia quyền tham gia Trò chơi sau khi đăng ký tại www.bridgestonerivals.com và đủ điều kiện nhận Giải thưởng, do việc hoàn thành các biểu mẫu cần thiết liên quan đến việc trao Giải thưởng.

3. MIỄN TRỪ TRÁCH NHIỆM

Bridgestone sẽ không chấp nhận:

a) Trách nhiệm đối với các bài dự thi và biểu mẫu Cuộc thi bị mất, thất lạc, hư hỏng hoặc bị trì hoãn trong quá trình truyền tải, bất kể lý do gì, bao gồm, ví dụ, do bất kỳ lỗi của bưu điện, trục trặc thiết bị, trục trặc kỹ thuật, hệ thống, vệ tinh, kết nối mạng, máy chủ, lỗi phần cứng hoặc phần mềm máy tính dưới bất kỳ hình thức nào;

b) Bằng chứng về việc đăng tải hoặc truyền đi được coi là bằng chứng nhận được bài dự thi cho Cuộc thi; hoặc;

c) Chịu trách nhiệm về bất kỳ sự chậm trễ, độ trễ thời gian, phản hồi chậm, kết nối chậm liên quan đến Cuộc thi hoặc hoạt động và hành động trong trò chơi (bao gồm các hành động liên quan đến đua xe), ví dụ, do vị trí xa của máy chủ hoặc kết nối mạng kém.

4. GIẢI THƯỞNG

a) Giải thưởng sẽ chỉ được trao nếu Người tham gia tuân thủ đầy đủ các Quy chế Chính thức và Thể lệ thi đấu. Trường hợp Người tham gia vi phạm bất kỳ điều khoản nào của Quy chế Chính thức và Thể lệ thi đấu, Người tham gia sẽ bị loại khỏi Cuộc thi và mất quyền nhận bất kỳ Giải thưởng nào được ghi trong Thể lệ thi đấu

b) Bridgestone sẽ liên hệ với những người chiến thắng để thông báo cho họ về các sắp xếp hậu cần cần thiết để đổi Giải thưởng, các sắp xếp hậu cần này sẽ được xác định theo quyết định riêng của Bridgestone. Bridgestone không chịu trách nhiệm về bất kỳ thiệt hại nào (bị mất, bị đánh cắp, giả mạo hoặc can thiệp) hoặc chậm trễ xảy ra trong quá trình vận chuyển Giải thưởng. Trong trường hợp sản phẩm bị hư hỏng hoặc lỗi bất kỳ, người thắng giải phải liên hệ với nhà sản xuất của sản phẩm. Giải thưởng không được chuyển nhượng, hoàn trả hoặc đổi sang giải thưởng khác để phù hợp với sở thích của người thắng giải, và phải được chấp nhận theo hình thức trao tặng liên quan đến các hoạt động mà người thắng giải thực hiện và không thể bán lại vì mục đích lợi nhuận. Bất kỳ khoản thuế và thuế quan nào đối với Giải thưởng đều do người thắng giải chịu hoàn toàn trách nhiệm.

c) Bridgestone và các công ty liên kết của Bridgestone có quyền thay đổi, sửa đổi hoặc thay thế Giải thưởng, mà không cần thông báo trước và bất kỳ lúc nào, với một giải thưởng có giá trị tương đương được Bridgestone cho là phù hợp.

d) Bridgestone sẽ nỗ lực hợp lý để liên hệ với những người chiến thắng Giải thưởng ngay sau khi công bố người chiến thắng.

e) Những người chiến thắng Giải thưởng sẽ có bảy (7) ngày kể từ ngày thông báo để nhận Giải thưởng theo hướng dẫn trong thư điện tử thông báo và hoàn tất ký các biểu mẫu liên quan đến Giải thưởng theo yêu cầu của Bridgestone. Nếu các biểu mẫu nói trên không được ký và Giải thưởng không được nhận trong khoảng thời gian bảy (7) ngày, Giải thưởng sẽ bị coi là bị hủy bỏ. Bên thứ ba không được phép nhận Giải thưởng thay mặt cho người thắng giải. Bridgestone có quyền trao các Giải thưởng chưa có người nhận cho Người tham gia đủ điều kiện tiếp theo và/hoặc vô hiệu hóa các Giải thưởng chưa có người nhận.

f) Người chiến thắng xác nhận chấp nhận Giải thưởng trong thời hạn bảy (7) ngày sẽ có ba mươi (30) ngày để cung cấp cho Bridgestone bằng chứng về tất cả các tài liệu được áp dụng bao gồm nhưng không giới hạn các biểu mẫu đã ký liên quan đến Giải thưởng (“Chứng từ hợp lệ”) như được nêu trong Mục 1.1. Trong trường hợp Người chiến thắng không xuất trình được Chứng từ hợp lệ trong thời hạn ba mươi (30) ngày, người chiến thắng thừa nhận và chấp nhận việc bị thu hồi Giải thưởng, trong trường hợp đó, Bridgestone có quyền trao Giải thưởng bị thu hồi cho Người tham gia đủ điều kiện tiếp theo và / hoặc vô hiệu Giải thưởng.

g) Bridgestone không chịu bất kỳ trách nhiệm nào nếu người chiến thắng không thể nhận được Giải thưởng.

h) Bridgestone có quyền hoãn trao Giải thưởng cho người thắng giải, với những lý do hợp lý và có cơ sở.

5. GIỚI HẠN TRÁCH NHIỆM

a) Trong phạm vi pháp luật cho phép, Giải thưởng được cung cấp 'nguyên trạng' mà không có bất kỳ bảo đảm nào, bất kể là rõ ràng hay ngầm định, bao gồm nhưng không giới hạn, bảo đảm ngầm về khả năng giao thương trên thị trường, tính phù hợp cho một mục đích cụ thể nào hoặc không vi phạm.

b) Trong phạm vi pháp luật cho phép, Bridgestone, đại lý hoặc nhà phân phối của họ sẽ không chịu bất kỳ trách nhiệm hoặc có nghĩa vụ bồi thường cho người chiến thắng hoặc chấp nhận bất kỳ trách nhiệm nào đối với bất kỳ khiếu nại, yêu cầu, thiệt hại, trách nhiệm, chi phí hoặc phí tổn nào, bất kể là trực tiếp, gián tiếp, do hậu quả, ngẫu nhiên hoặc đặc biệt, bao gồm nhưng không giới hạn đến thương tích cá nhân, thiệt hại tài sản hoặc mất mát sử dụng xảy ra do tham gia Cuộc thi hoặc liên quan đến việc nhận Giải thưởng, cho dù khiếu nại dựa trên hợp đồng, ngoài hợp đồng (bao gồm cả sơ suất), trách nhiệm nghiêm ngặt hoặc khác. Ngoài ra, Bridgestone, đại lý hoặc nhà phân phối của họ từ chối bất kỳ trách nhiệm nào liên quan đến bất kỳ chứng nhận, ủy quyền hoặc ủy quyền thi đấu nào liên quan đến Cuộc thi hoặc eSports.

c) Bridgestone, đại lý hoặc nhà phân phối của họ không chịu trách nhiệm về bất kỳ chi phí nào liên quan đến bất kỳ Giải thưởng hoặc việc tham gia Cuộc thi mà không được nêu rõ ràng là trách nhiệm của họ trong Quy chế Chính thức. Ngoài ra, mỗi người chiến thắng Giải thưởng phải chịu trách nhiệm hoàn toàn về tất cả các khoản thuế địa phương áp dụng, bao gồm cả thuế thu nhập.

d) Người chiến thắng đồng ý sử dụng Giải thưởng theo rủi ro của riêng mình. Bridgestone, đại lý hoặc nhà phân phối của họ sẽ không chịu trách nhiệm về bất kỳ mất mát, thiệt hại hoặc thương tích nào có thể phát sinh do việc sử dụng hoặc sở hữu Giải thưởng.

e) Bridgestone, đại lý hoặc nhà phân phối của họ sẽ không chịu bất kỳ trách nhiệm nào về bất kỳ hư tổn hoặc thiệt hại nào đối với máy tính hoặc máy chơi trò chơi của bất kỳ Người tham gia nào hoặc bất kỳ người nào khác, liên quan đến hoặc do việc tham gia hoặc tải xuống bất kỳ tài liệu nào liên quan đến Cuộc thi.

f) Người chiến thắng đồng ý bồi thường, bảo vệ và giữ vô hại cho Bridgestone, cán bộ, giám đốc, nhân viên, đại lý, người cấp phép, nhà cung cấp và bất kỳ nhà cung cấp thông tin bên thứ ba nào về Giải thưởng gồm tất cả các khoản lỗ, chi phí, thiệt hại và chi phí bao gồm cả phí luật sư hợp lý, phát sinh từ bất kỳ vi phạm tuyên bố miễn trừ trách nhiệm này bởi người chiến thắng hoặc bất kỳ người nào khác sở hữu hoặc sử dụng Giải thưởng.

g) Bridgestone, các đại lý hoặc nhà phân phối của họ sẽ không chịu trách nhiệm cho bất kỳ trường hợp nào không tuân thủ các nghĩa vụ liên quan đến Cuộc thi, nếu sự không tuân thủ đó là do một sự kiện nằm ngoài tầm kiểm soát hợp lý của họ hoặc do bất khả kháng (“Bất Khả Kháng”). Bất Khả Kháng bao gồm, nhưng không giới hạn ở, dịch bệnh, đại dịch, điều kiện thời tiết, hỏa hoạn, lũ lụt, bão, đình công, tranh chấp lao động, chiến tranh, thù địch, bất ổn chính trị, bạo loạn, bất ổn dân sự, tai nạn bất khả kháng, luật pháp thay đổi bất ngờ hoặc bất kỳ tình huống nào khác cấu thành bất khả kháng.

6. SỞ HỮU CÁC BÀI DỰ THI VÀ QUYỀN SỞ HỮU TRÍ TUỆ

a) Bằng việc gửi bài dự thi Cuộc thi và bất kỳ tài liệu kèm theo nào, Người tham gia đồng ý với những điều khoản sau, để đổi lấy cam kết của Bridgestone về việc cho phép Người tham gia tham gia Cuộc thi và tạo cơ hội cho Người tham gia được nhận Giải thưởng sau khi đăng ký và nộp các đơn từ: :

i. chuyển giao cho Bridgestone có tất cả các quyền sở hữu trí tuệ với bảo đảm đầy đủ quyền sở hữu; và

ii. theo giới hạn của luật pháp hiện hành tại quốc gia cư trú của Người tham gia, Người tham gia từ bỏ tất cả các quyền nhân thân đối với bài dự thi của mình và phát sinh liên quan đến việc tham gia Cuộc thi của Người tham gia mà ở thời điểm hiện tại hoặc bất kỳ lúc nào trong tương lai Người tham gia được hưởng theo tất cả các luật hiện hành.

b) Người tham gia đồng ý rằng Bridgestone có thể, nhưng không bắt buộc, công bố tên người chiến thắng và giải thưởng nhận được trên bất kỳ trang điện tử nào liên quan và bất kỳ phương tiện truyền thông nào khác, cho dù hiện tại đã biết hoặc được phát minh trong tương lai, và liên quan đến bất kỳ hoạt động quảng bá nào của Cuộc thi. Người tham gia đồng ý cấp cho Bridgestone một giấy phép không độc quyền, toàn cầu, không thể hủy ngang, trong toàn bộ thời gian của bất kỳ quyền sở hữu trí tuệ nào đối với bài dự thi Cuộc thi và bất kỳ tài liệu đi kèm nào, để sử dụng, hiển thị, xuất bản, truyền tải, sao chép, chỉnh sửa, thay đổi, lưu trữ, tái định dạng và cấp giấy phép phụ cho bài dự thi Cuộc thi và bất kỳ tài liệu đi kèm nào cho các mục đích đó.

c) Người tham gia không được liên kết mình với Cuộc thi theo bất kỳ cách thức thương mại nào, cũng không được sử dụng bất kỳ quyền sở hữu trí tuệ nào của Bridgestone, cũng không được sửa đổi, chuyển thể, dịch hoặc tạo các tác phẩm phái sinh, cũng không được cho phép bất kỳ bên thứ ba nào thực hiện việc đó mà không có sự đồng ý trước đó bằng văn bản của Bridgestone. Việc ghi âm, phổ biến hoặc khai thác bất kỳ hình ảnh nào của Cuộc thi mà không có sự chấp thuận trước của Bridgestone đều bị nghiêm cấm.

7. BẢO MẬT DỮ LIỆU VÀ CÔNG BỐ
7.1 Chính sách bảo mật

Bằng việc đăng ký tham gia Cuộc thi, Người đua bảo đảm rằng họ đã đọc kỹ Điều 7 này (“Chính sách Dữ liệu Cá nhân của Bridgestone”) bao gồm các giải thích cách Bridgestone và các công ty liên kết của Bridgestone thu thập, sử dụng, chia sẻ và tiết lộ dữ liệu cá nhân của Người tham gia trong suốt Cuộc thi, và các biện pháp bảo vệ dữ liệu mà Bridgestone và các công ty liên kết của Bridgestone đã thực hiện để bảo vệ quyền riêng tư của Người tham gia, và đồng ý với (i) Việc Bridgestone thu thập từ Người tham gia các gamertag, địa chỉ email và vị trí của Người tham gia; (ii) Microsoft Corporation hoặc các công ty liên kết của Microsoft (“Microsoft”) xác minh và kiểm chứng dữ liệu đó được thu thập từ Người tham gia; (iii) Microsoft tiết lộ cho Bridgestone và các công ty liên kết của Bridgestone bảng xếp hạng theo thời gian đua ở mỗi Quốc gia đủ điều kiện; và (iv) việc xử lý dữ liệu cá nhân của Người tham gia (cho dù được Microsoft tiết lộ hoặc gửi cho Bridgestone và các công ty liên kết của Bridgestone thông qua https://www.bridgestonetire.com/support/tire-registration/) theo Điều 7 này cho các mục đích được nêu ra dưới đây.

Bằng việc tham gia Cuộc thi, Người tham gia thừa nhận, đồng ý và chấp nhận rằng việc thu thập, xử lý và tiết lộ dữ liệu cá nhân của họ (cho dù bởi Bridgestone hay Microsoft) theo Chính sách Dữ liệu Cá nhân của Bridgestone và Điều 7 này là cần thiết, hợp lý và phù hợp để Bridgestone tổ chức, quản lý, tiến hành và công bố Cuộc thi, bao gồm nhưng không giới hạn ở:

(e) Phát sóng, quảng cáo và bất kỳ hình thức công khai nào khác được cho là phù hợp cho Cuộc Thi; (f) Trao Giải thưởng; và

(g) Bất kỳ mục đích nào khác cần thiết để Bridgestone thực hiện các nghĩa vụ theo Quy chế chính thức.

7.2 Thu thập và Sử dụng.

Bằng việc tham gia Cuộc thi, Người tham gia đồng ý với những điều sau:

7.2.1 Việc Bridgestone và các công ty liên kết của Bridgestone thu thập và sử dụng thông tin cá nhân của Người tham gia trong suốt Cuộc thi, cho dù được thu thập trực tiếp từ Microsoft, Người tham gia hay bằng cách khác, bao gồm nhưng không giới hạn khi Bridgestone hoặc các công ty liên kết của Bridgestone xử lý dữ liệu cá nhân của Người tham gia để xác định người chiến thắng, xác minh thành tích của Người tham gia với Microsoft, sắp xếp trao Giải thưởng và công bố tên người chiến thắng và Giải thưởng nhận được trên bất kỳ trang web liên quan nào và bất kỳ phương tiện truyền thông nào khác và khi Người tham gia sử dụng các sản phẩm và dịch vụ của Bridgestone và các công ty liên kết của Bridgestone, chẳng hạn như khi Người tham gia nhận dịch vụ từ Bridgestone hoặc các công ty liên kết của Bridgestone.

7.2.2 Việc Bridgestone và các công ty liên kết của Bridgestone sử dụng thông tin của Người tham gia được thu thập để đảm bảo hoạt động và quản lý phù hợp cho Cuộc thi, tiến hành các chương trình khuyến mãi tặng quà và cung cấp các sản phẩm và dịch vụ của Bridgestone và các công ty liên kết của Bridgestone cho Người tham gia.

7.2.3 Việc Bridgestone và các công ty liên kết của Bridgestone sử dụng thông tin của Người tham gia được thu thập cho mục đích công khai, theo quy định trong các Quy chế Chính thức này; và để thông báo cho Người tham gia khi họ giành chiến thắng trong Cuộc thi, sắp xếp nhận Giải thưởng, hoặc nếu có cập nhật về Cuộc thi (chẳng hạn như khi Cuộc thi kết thúc), và để cho Người tham gia biết về các chương trình khuyến mãi đặc biệt, sự kiện và thay đổi chính sách, bằng cách sử dụng email, tin nhắn văn bản và thông báo đẩy.

7.2.4 Việc Bridgestone và các công ty liên kết của Bridgestone thu thập dữ liệu tổng hợp và/hoặc thống kê phản ánh sự tham gia của Người tham gia vào Cuộc thi, trong đó Bridgestone và các công ty liên kết của Bridgestone sử dụng dữ liệu tổng hợp và/hoặc thống kê đó để theo dõi, báo cáo và các hoạt động khác liên quan đến hoạt động kinh doanh của Bridgestone và các công ty liên kết của Bridgestone, và theo tuân theo Chính sách bảo mật của Bridgestone.

7.3 Chia sẻ và Tiết lộ.

Bridgestone không chia sẻ, giao dịch, cho thuê, bán hoặc tiết lộ dữ liệu cá nhân của Người tham gia cho các công ty không liên kết, trừ trường hợp Người tham gia đồng ý rằng Bridgestone có thể chia sẻ dữ liệu cá nhân của Người tham gia khi cần thiết, với các công ty liên kết của mình, các nhà cung cấp dịch vụ bên thứ ba để xử lý dữ liệu cá nhân của Người tham gia thay mặt cho Bridgestone và các đối tác tham gia Cuộc thi; để cung cấp bất kỳ hoạt động hoặc hỗ trợ nào cho các sản phẩm và dịch vụ do Người tham gia yêu cầu hoặc ủy quyền; hoặc với các nhà cung cấp, nhà bán hàng và nhà điều hành Giải thưởng bên thứ ba. Các đối tác tham gia Cuộc thi bao gồm nhưng không giới hạn: Microsoft và Turn 10 Studios.

7.4 Lưu trữ Thông tin.

Bằng việc đăng ký và tham gia Cuộc thi, Người tham gia đồng ý cho Bridgestone và các công ty liên kết của Bridgestone lưu trữ và xử lý dữ liệu cá nhân của Người tham gia tại bất kỳ quốc gia nào của Bridgestone hoặc các chi nhánh, công ty con hoặc nhà cung cấp dịch vụ của Bridgestone. Bridgestone thực hiện các bước để đảm bảo rằng dữ liệu được thu thập được xử lý theo Chính sách Dữ liệu Cá nhân của Bridgestone, Quy chế Chính thức và các luật bảo vệ dữ liệu cá nhân áp dụng tại các Quốc gia đủ điều kiện.

8. ĐIỀU KHOẢN CHUNG

a) Nếu có bất kỳ lý do nào để tin rằng đã xảy ra vi phạm Quy chế Chính thức và / hoặc Thể lệ Thi đấu, Bridgestone có toàn quyền quyết định loại Người tham gia khỏi Cuộc thi.

b) Mọi quyết định liên quan đến việc giải thích Quy chế Chính thức, Thể lệ Thi đấu, sự hợp lệ, lịch trình và tổ chức Cuộc thi đều thuộc quyền của Bridgestone (và bất kỳ ai thực hiện thay mặt cho Bridgestone), Bridgestone có quyết định cuối cùng. Trừ khi được quy định khác trong luật hiện hành bắt buộc của quốc gia cư trú của Người tham gia mà không thể thực hiện khác đi theo thỏa thuận, các quyết định của Bridgestone không thể bị khiếu nại và sẽ không dẫn đến bất kỳ yêu cầu bồi thường thiệt hại bằng tiền hoặc bất kỳ biện pháp khắc phục pháp lý hoặc công bằng nào khác. c) Bridgestone có quyền tạm dừng, hủy bỏ hoặc sửa đổi Cuộc thi khi cần thiết.

Official Rules ("Official Rules")

The Bridgestone Rivals – Race to the Top 2024 (“Competition”) is organized by Bridgestone Asia Pacific Pte Ltd with its registered address at 83 Clemenceau Avenue, 8^th Floor, Singapore 239920 (“Bridgestone”).

By entering the Competition, all Racers accept and agree to abide by and by bound by these Official Rules and Racing Rules (as defined below). Registration is required in order to participate in the Competition.

The prizes shall include an OSIM chair, among other prizesto be solely determined by Bridgestone (collectively hereinafter defined as “Prizes”) will be awarded in compliance with the Official Rules and Racing Rules.

1. RACERS ELIGIBILITY

1.1 Registration Period(s); Acceptance of the Official Rules and Racing Rules

To participate in the Competition and to qualify for the Prizes, Racers must;

a) Comply with entry requirements for the Competition as published at www.bridgestonerivals.com;

b) Accept the stated terms and conditions located within the racing simulation video game known as “Forza Motorsports”, the eighth edition (codename: Steelhead), including any version updates made thereto from time to time(“Game”) – including but not limited to accepting and acknowledging that "By participating in this event, you (the Racer) consent to sharing the gamertags, email addresses, location with Bridgestone and its affiliated companies” and to be contacted by Bridgestone or its affiliated companies regarding the Competition;

c) Register with Bridgestone by signing up at www.bridgestonerivals.com and complete the necessary registration and relevant forms related to the Prize offering, which are required by Bridgestone to be eligible for the Prizes;

d) Have a valid Game Pass subscription and valid copy of the Game or valid license to play the Game at the time of the Competition and during the Registration Period as stated below;

e) be of at least 18 years old or have reached the minimum age to enter into contract by themselves without parental consent under the laws applicable to the location as registered in their Game Pass subscription account, whichever is older, at the time of registration;

f) submit their race times in accordance with the rules or guidelines that Bridgestone may publish and update from time to time at www.bridgestonerivals.com; and

g) To qualify for the Prizes, a minimum of two (2) registered Racers are required in any applicable Eligible Country.

Racers must fulfill all the conditions stated above and all registration forms must be completed and received by Bridgestone within the Registration Period.

By submitting a registration form and by participating in the Competition, Racers warrant that they (i) are eligible to register and participate;(ii) have read and accepted these Official Rules, the Racing Rules and the Bridgestone Privacy Policy and that the Official Rules constitute a binding contract between the Racers and Bridgestone. Racers agree to be bound by these Official Rules, the Racing Rules, and the decisions of Bridgestone in the context of the Competition.

Racers acknowledge that Microsoft and any other Bridgestone partners' or contractors’ activities are governed by their respective terms and conditions and privacy policies. Bridgestone and its affiliated companies take no responsibility for any terms of use or policies other than its own. Racers agree that Bridgestone reserves all rights and has full discretion to disqualify a Racer if they violate any of the terms of the Official Rules, the Racing Rules or if their conduct is contrary to the spirit or good standing of the Competition.

Bridgestone reserves the right:

a) to alter, amend or supplement these Official Rules and Racing Rules from time to time as it deems fit;

b) to cancel, change or suspend the Competition, or any part of it, if cheating, a virus, bug, or any other unforeseen or unexpected event that affects the conduct, safety, fairness and/or integrity of the Competition.

c) to modify, suspend, postpone, or discontinue, temporarily or permanently, at any time and from time to time, the Competition, or any part of it, with or without prior notice, for reasons outside its reasonable control, including, without limitation, any Force Majeure event (as Force Majeure is defined in Section 5(h) below).

1.2 Residency

Racers must be legal residents in an eligible location to participate in the Competition. Schedule 1 shows a list of all eligible locations and their corresponding regional classification (“Eligible Location”).

1.3 Bridgestone Employees; conflict of interests

The officers, directors and employees of Bridgestone, Microsoft, Turn 10 Studios, their subsidiaries and affiliated companies, as well as all advertising, marketing and judging agencies, persons engaged in the development, production or distribution of materials for this Competition and immediate family members (parents, step-parents, grandparents, children, step-children, siblings, civil partners or spouses) or persons living in the same household (whether related or not) are not eligible to participate in this Competition.

2. REQUIREMENTS TO PARTICIPATE

2.1 Right to Verify Eligibility

Racers shall provide proof of eligibility. Bridgestone reserves the right to verify the eligibility of Racers (including but not limited to any minimum age requirements, legal residency, or other requirements pursuant to the laws and regulations of the Eligible Location) at any time during the Competition to the extent required for the purposes of the Competition by requesting the Racers to produce any documentation of eligibility as Bridgestone deems fit. Following Bridgestone’s verification of documentation of eligibility (if any) provided by the Racers, Bridgestone reserves the right to disqualify and reject eligibility of the Racers for participation in the Competition or remove the right to receive Prizes to winners for any reason whatsoever.

Failure to adhere to such verification procedures will result in disqualification from the Competition and/or withdrawal of the Prizes.

2.2 Invalid Entries

Bridgestone will not accept Competition entries that are:

a) automatically generated by computer;

b) completed by third parties or in bulk;

c) altered, reconstructed, forged or tampered with in any way whatsoever; or

d) incomplete.

Further, Bridgestone will reject any Competition entry made using a gamertag that is not associated with the Game Pass account that the Racer has registered with Bridgestone through www.bridgestonerivals.com.

2.3 Entries per Person

Each Racer may only participate in the Competition under one account. Competition entries on behalf of another person will not be accepted and joint submissions are not permitted.

2.4 Photographs, Audio and Video

Racers agree to be interviewed, photographed, and filmed during any or all stages of the Competition, and hereby grant Bridgestone, its group companies and their licensees the right and entitlement to use and exploit any resulting footage, streams, stills, audio and quotes for their own broadcasting and advertising purposes in connection with the Competition, all the finals and/or the Competition, in perpetuity, in all media. The consideration for the granting of the rights provided herein is Bridgestone granting access to participate in the Game upon registration at www.bridgestonerivals.com and eligibility for the Prizes, as a result of completion of the necessary forms related to the Prize offering.

3. DISCLAIMER

Bridgestone will not accept:

a) responsibility for Competition entries and forms that are lost, mislaid, damaged or delayed in transit, regardless of cause, including, for example, as a result of any postal failure, equipment failure, technical malfunction, systems, satellite, network, server, computer hardware or software failure of any kind;

b) proof of posting or transmission as proof of receipt of an entry to the Competition; or

c) responsibility for any delay, time lag, slow response, slow connection related to the Competition or to in-game activity and actions (including racing-related actions), for example, due to remoteness of the server(s) or poor internet connection.

4. PRIZES

a) Prizes will be granted only if participating Racers fully comply with these Official Rules and Racing Rules. In case of breach of any provision of these Official Rules and Racing Rules by Racers, they will be disqualified from the Competition and lose any right to receive the Prizes indicated in the Racing Rules.

b) Bridgestone or its affiliated companies will contact the winners to notify them of the necessary logistics arrangements for the redemption of the Prizes, such logistics arrangements to be determined at Bridgestone’s sole discretion. Bridgestone and its affiliated companies are not liable for any damage (whether lost, stolen, forged or tampered with) or delay occurring in the transit of Prizes. In the event of any damage or defect whatsoever, the winner shall contact the manufacturer of the product. Prizes are not transferable, refundable or exchangeable to accommodate the preferences of the winners, and must be accepted as awarded in respect of the services performed and cannot be resold for profit. Any taxes and any duties on the Prizes are the winners’ sole responsibility.

c) Bridgestone and its affiliated companies reserve the right to alter, change or replace the Prizes, without any prior notice and at any time, with a prize of a similar value, as it deems fit.

d) Bridgestone and its affiliated companies will make all reasonable efforts to contact the winners of the Prizes as soon as practicable after the announcements of the winners.

e) The winners of the Prizes will have seven (7) days from notification to claim the Prizes as instructed in their notification email and to sign the relevant forms related to the Prize offering as required by Bridgestone or its affiliated companies. If the said forms are not signed and the Prizes are not claimed within the said seven (7) day period, the Prizes will be considered forfeited. The Prizes may not be claimed by a third party on behalf of the winners. Bridgestone and its affiliated companies reserve the right to offer the unclaimed Prizes to the next eligible Racer and/or void unclaimed Prizes.

f) Winners who acknowledge acceptance of Prizes within the seven (7) days’ period will have thirty (30) days after the seven (7) days’ period to provide Bridgestone and its affiliated companies with proof of all applicable documentation including but not limited to signed forms related to the Prize offering (“Prize Eligibility Documents”) as outlined in Section 4(e) or as may be requested by Bridgestone or its affiliated companies in accordance with Section 2.1. In the event Winners fail to produce the Prize Eligibility Documents within the thirty (30) days’ period, the winner acknowledges and accepts forfeiture of the Prize, in which instance Bridgestone reserves the right to offer forfeited Prizes to the next eligible Racer and/or void the Prize.

g) Bridgestone and its affiliated companies do not accept any responsibility if the winners are not able to receive their Prizes.

h) Bridgestone reserves the right to withhold Prizes from the winners, upon reasonable and justifiable grounds .

5. LIMITATION OF LIABILITY

a) In so far as permitted by law, the Prizes are provided 'as is' without any warranties of any kind, either express or implied, including but not limited to, the implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

b) Insofar as is permitted by law, Bridgestone and its affiliated companies, their agents or distributors will not in any circumstances be responsible or liable to compensate the winners or accept any liability for any claims, demands, damages, liabilities, costs or expenses of any kind, whether direct, indirect, consequential, incidental, or special, including but not limited to personal injury, property damage, or loss of use occurring as a result of participating in the Competition or in connection with or taking up the Prizes, whether the claim is based in contract, tort (including negligence), strict liability, or otherwise. Furthermore, Bridgestone, its affiliated companies, their agents or distributors disclaim any liability regarding any certifications, authorizations or contests authorization related to the Competition.

c) Bridgestone, its affiliated companies, their agents or distributors accept no responsibility for any costs associated with any Prizes or participation in the Competition that are not expressly stated to be their responsibility in these Official Rules. Additionally, each winner of a Prize is solely responsible for all applicable federal, state and local taxes, including but not limited taxes imposed on its income.

d) Winners agree to use the Prizes at their own risk. Bridgestone, its affiliated companies, their agents or distributors shall not be responsible for any loss, damage, or injury that may result from the use or possession of the Prizes.

e) Bridgestone, its affiliated companies, their agents or distributors shall have no liability whatsoever for any injury or damage to any Racer or any other person’s computer or console, relating to or resulting from participation in or downloading any materials in connection with the Competition.

f) Winners agree to indemnify, defend, and hold harmless Bridgestone, its affiliated companies, their officers, directors, employees, agents, licensors, suppliers, and any third-party information providers to the Prizes from and against all losses, expenses, damages, and costs, including reasonable attorneys' fees, resulting from any violation of these Official Rules by a winner or any other person having possession or use of the Prizes.

g) Bridgestone, its affiliated companies, their agents or distributors shall not be liable for any failure to comply with their obligations relating to the Competition where the failure is caused by something outside their reasonable control or force majeure (“Force Majeure”). Such Force Majeure shall include, but is not limited to, epidemic, pandemic, weather conditions, fire, flood, hurricane, strike, industrial dispute, war, hostilities, political unrest, riots, civil commotion, inevitable accidents, supervening legislation or any other circumstances amounting to force majeure.

6. OWNERSHIP OF COMPETITION ENTRIES AND INTELLECTUAL PROPERTY RIGHTS

a) By submitting a Competition entry and any accompanying material, the Racer agrees, with Bridgestone’s commitment to grant access to participation in the Game and offering eligibility for the Prizes upon registration and submission of forms respectively , to:

i. assign to Bridgestone all intellectual property rights with full title guarantee; and

ii. waive within the limits provided by applicable laws in the country of Racer’s residence - all moral rights in and to the Racers competition entry and otherwise arising in connection with the Racers entry to which the Racers may now or at any time in the future be entitled under all applicable legislations.

b) The Racer agrees that Bridgestone and its affiliated companies may, but is not required to, publish winners’ names and Prizes received on any relevant website and any other media, whether now known or invented in the future, and in connection with any publicity of the Competition. The Racer agrees to grant Bridgestone and its affiliated companies a non-exclusive, worldwide, irrevocable license, for the full period of any intellectual property rights in the Competition entry and any accompanying materials, to use, display, publish, transmit, copy, edit, alter, store, reformat and sublicense the Competition entry and any accompanying materials for such purposes.

c) Racers shall not associate themselves with the Competition in any commercial manner, nor use any intellectual property rights of Bridgestone and its affiliated companies, nor modify, adapt, translate or create derivative works from the intellectual property of Bridgestone and its affiliated companies, nor shall they permit any third parties to do so, without the prior written consent of Bridgestone. The recording, dissemination, or any exploitation of images of the Competition without Bridgestone's prior approval is strictly prohibited.

7. BRIDGESTONE PRIVACY POLICY

7.1 Warrant and Consent.

By registering for the Competition, Racers warrant that they have carefully read this Section 7 (“Bridgestone Privacy Policy”), which explains how Bridgestone and its affiliated companies collect, use, share, and disclose Racers’ personal information during the Competition, and the data protections that Bridgestone and its affiliated companies have put in place to protect the privacy of Racers, and hereby consent: (i) to Bridgestone’s collection from the Racers of the gamertags, email addresses and location of the Racers; (ii) for Microsoft Corporation’s or its affiliated companies’ (“Microsoft”) verification and substantiation of such information collected from Racers; (iii) Microsoft’s disclosure to Bridgestone and its affiliated companies of the rankings by racing time in each Eligible Location; and (iv) the processing of their personal information (whether disclosed by Microsoft or submitted to Bridgestone and its affiliated companies via www.bridgestonerivals.com) in accordance with this Section 7 for the purposes set out below.

The Racers hereby acknowledge, agree and accept that the collection, processing and disclosure of their personal information (whether by Bridgestone or Microsoft) under the Bridgestone Privacy Policy and this Section 7 is necessary, reasonable and appropriate for Bridgestone to organize, administer, conduct and publicize the Competition, including but not limited to:

(a) verifying the Racers’ eligibility to participate in the Competition and to qualify for the Prizes for each Eligible Location;

(b) verifying the Racers’ achievement and rankings in the Competition;

(d) determination and announcement of the winners in each Eligible Location;

(e) broadcasting, advertising and any other form of publicity deemed appropriate for the Competition;

(f) delivery of the Prizes; and

(g) any other purpose that is necessary for Bridgestone to discharge its obligations under the Official Rules.

7.2 Collection and Use.

By entering the Competition, Racers hereby consent to:

7.2.1 Bridgestone and its affiliated companies’ collection and use of Racers’ personal information during the Competition whether collected directly from Microsoft, Racers or otherwise, including but not limited to when Bridgestone or its affiliated companies process Racers’ personal information to determine the winners, verify the Racers’ achievement with Microsoft, arranging for the Prizes to be delivered and publishing winners’ names and Prizes received on any relevant website and any other media and when a Racer uses Bridgestone and its affiliated companies’ products and services, such as when a Racer receives services from Bridgestone or its affiliated companies;

7.2.2 Bridgestone and its affiliated companies’ use of the information of the Racers collected to ensure the proper operation and administration of the Competition, conduct promotional giveaways and to provide Bridgestone and its affiliated companies’ products and services to Racers;

7.2.3 Bridgestone and its affiliated companies’ use of the information of the Racers collected for publicity purposes , as stated within these Official Rules; and to notify Racers when they win the Competition, arrange for collection of a Prize, or if there are updates to Competition (such as when the Competition closes), and to let Racers know of special promotions, events and policy changes, using emails, text messages and push notifications; and

7.2.4 Bridgestone and its affiliated companies’ collection of aggregated and/or statistical data reflecting Racers’ participation in Competition, where Bridgestone and its affiliated companies use such aggregated and/or statistical data for tracking, reporting and other activities in connection with Bridgestone and its affiliated companies’ business, and in accordance with Bridgestone's Privacy Policy.

7.3 Sharing and Disclosure.

Bridgestone does not share, trade, rent, sell or otherwise disclose Racers’ personal information to unaffiliated companies, save and except that Racers agree that Bridgestone may share Racers’ personal information as necessary, with its affiliated companies, third party service providers to process Racers’ personal information on Bridgestone’s behalf and partners involved in the Competition; to provide any operations or support to products and services requested or authorized by the Racer; or with third party providers, vendors and operators of the Prizes. Without limitation, partners involved in the Competition are: Microsoft and Turn 10 Studios.

7.4 Storage of Information.

By registering and entering in the Competition, Racers consent to Bridgestone and its affiliated companies to store and process personal information of Racers in any country of Bridgestone or its affiliates, subsidiaries, or its service providers . Bridgestone takes steps to ensure that the data it collects is processed in accordance with the Bridgestone Privacy Policy and the Official Rules, and the applicable personal data protection laws in the Eligible Locations.

8. GENERAL

a) If there is any reason to believe that there has been a breach of these Official Rules and/or the Racing Rules, Bridgestone may, at its sole discretion, reserve the right to exclude the Racer from participating in the Competition.

b) All decisions regarding the interpretation of these Official Rules, Racing Rules, eligibility, scheduling and staging of the Competition lie solely with Bridgestone (and anyone acting on its behalf), whose decisions are final. Unless otherwise provided for in the mandatory applicable laws of Racer’s country of residence that cannot be derogated from by agreement, Bridgestone’s decisions cannot be appealed and shall not give rise to any claim for monetary damages or any other legal or equitable remedy. Racers agree to be bound by Bridgestone’s (and anyone acting on its behalf) final decisions.

c) Bridgestone reserves the right to hold void, suspend, cancel, or amend the Competition where it becomes necessary to do so.

d) If any provision of this Agreement is held to be illegal or invalid for any reason, the illegality or invalidity shall not affect the remaining provisions hereof, but such provision shall be fully severable and this Agreement shall be construed and enforced as if the illegal or invalid provision had never been included herein.

e) Unless otherwise provided for in the mandatory applicable laws of Racer’s country of residence that cannot be derogated from by agreement, these Official Rules shall be governed by the laws of Singapore , and .

any dispute arising out of or in connection with the Official Rules, including any question regarding its existence, validity or termination, shall be referred to and finally resolved by arbitration administered by the Singapore International Arbitration Centre in accordance with the Arbitration Rules of the Singapore International Arbitration Centre for the time being in force, which rules are deemed to be incorporated by reference in this clause. The seat of the arbitration shall be Singapore. The Tribunal shall consist of one (1) arbitrator. The language of the arbitration shall be in English.

f) The Official Rules shall be translated and available in local language depending on the requirements of the Eligible Locations; provided always that the Racer hereby agrees that in the event of any inconsistencies between the local language version and this English version, the English version of the Official Rules shall always prevail, and the local language version of the Official Rules shall not be construed in any manner whatsoever as superseding, replacing or amending the English version thereof. Only the English version of the Official Rules is considered official. All translated versions into local language are unofficial and are for reference only.
